Terms of service

Effective date: September 16, 2026

Overview

Welcome to Manual Goalposts. The terms “Manual Goalposts,” “Historic Manual Stadium Goalpost Souvenirs,” “we,” “us,” and “our” refer to ManualGoalposts.com. We operate manualgoalposts.com and the related online store, including all information, content, features, tools, products, and services offered through the website (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them (collectively, the “Terms”), describe your rights and responsibilities when you visit, interact with, or use the Services or purchase our products.

Please read these Terms carefully. They contain important information about product variations, made-to-order and personalized products, cancellations, warranties, and limitations of liability.

By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy, available at Privacy policy – ManualGoalposts.com. If you do not agree to these Terms or the Privacy Policy, do not use the Services.

Section 1 Access and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you permit a minor dependent to use the Services on a device you own or manage, you accept responsibility for that use.

To browse our store or purchase a product, you may be asked to provide information such as your name, email address, billing information, payment information, shipping address, and customization instructions. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.

You are responsible for maintaining the security of any account credentials and for activity under your account. You may not transfer, sell, assign, or license your account to another person.

Section 2 Our Products

Authentic historic material

Certain products contain authentic material cut from original goalposts removed from historic Manual Stadium. Because this material is historic and was previously installed and exposed to use, weather, handling, removal, cutting, and fabrication, each piece is unique. Authentic metal may show differences in color, paint coverage, thickness, texture, oxidation, scratches, dents, wear, cut edges, markings, or other evidence of its history. These characteristics are part of the product and are not defects.

Handmade and resin variations

Many products are individually assembled, cast, finished, or otherwise handmade. Resin and other handcrafted components may include slight variations in dimensions, color, clarity, surface texture, positioning, alignment, finish, bubbles, inclusions, or other small irregularities. Logo placement, historic metal placement, back-plate color, numbering, and the appearance of optional accessories may vary slightly from product photographs. Reasonable handmade and historic-material variations are not defects.

Photographs and colors

We make reasonable efforts to describe and photograph products accurately. Photographs may show a representative example rather than the exact piece you will receive, unless the listing expressly states otherwise. Colors and appearance can vary because of lighting, photography, screen type, display settings, and the natural or handmade characteristics described above. We do not guarantee that your device will display colors or details exactly.

Personalized, made-to-order, and limited-edition products

Some products are made or finished after an order is placed and may include requested graduation years, numbers, logo styles, colors, inscriptions, back plates, stands, cork backing, or other selections. You are responsible for reviewing all names, years, numbers, colors, and other selections before submitting your order. We may contact you if instructions are unclear or cannot be completed as requested. Production time may be delayed until we receive the information or approval needed to proceed.

Limited-edition numbers are subject to availability. A requested number is not reserved until we confirm the order and availability. If a requested number is unavailable, we may contact you to select another available number, accept the next available number, or receive a refund for the affected item.

Display and care

Our goalpost pieces are decorative collectibles and souvenirs. They are not toys, structural components, sporting equipment, or safety equipment. Historic metal pieces may be heavy and may include cut edges or corners. Handle and display them carefully, keep them away from children and pets, and place them on a stable surface. Any stand or cork backing is intended as a display or surface-protection accessory and does not permanently secure the product or prevent tipping, falling, sliding, or surface damage.

Avoid prolonged exposure to excessive heat, direct sunlight, moisture, harsh chemicals, and abrasive cleaners, which may affect resin, paint, adhesives, cork, printed elements, or other finishes. Any care instructions supplied with a product form part of these Terms.

Availability and changes

Historic material and limited-edition products are available only while supplies last. We may change product descriptions, options, pricing, production methods, quantities, or availability, or discontinue a product, at any time without notice. We may limit quantities offered to any person, household, order, geographic area, or jurisdiction.

Section 3 Orders, Customization, and Cancellations

Placing an order is an offer to purchase. We may accept, reject, limit, or cancel an order for reasons including product or historic-material availability, an unavailable limited-edition number, suspected fraud, pricing or listing errors, an inability to complete requested customization, or a shipping restriction. An automated order confirmation acknowledges that we received your order; it does not necessarily mean that we have accepted or begun producing it. Payment must be authorized and processed before an order is accepted.

Review your order carefully before submitting it. If you need to request a correction or cancellation, contact us promptly at manualgoalposts@gmail.com. We will try to help, but we cannot guarantee that a change or cancellation can be made after production, personalization, resin casting, cutting, finishing, packing, or shipment has begun.

Because personalized and made-to-order products are created for a particular customer, they cannot be returned or exchanged merely because the customer changed their mind, selected the wrong option, or submitted incorrect customization information. This does not affect rights that cannot lawfully be waived, including remedies for an item that arrives damaged, is defective, or materially differs from the accepted order.

If we reject, change, or cancel an order, or need clarification, we will attempt to contact you using the email address, telephone number, or billing information supplied with the order. If we cancel an item after payment, we will refund the amount paid for that item and any associated shipping charge that is not otherwise used to fulfill the remainder of the order.

Purchases are also subject to our Refund Policy, available at Refund policy – ManualGoalposts.com. If these Terms conflict with the Refund Policy on a product-specific return issue, the Refund Policy will control unless applicable law requires otherwise.

Products are offered for personal, gift, alumni, school-spirit, and household use. You may not purchase products for commercial resale or export without our prior written permission.

Section 4 Prices, Promotions, and Billing

Prices, discounts, product options, and promotions may change without notice. The price charged will be the price shown when the order is placed, subject to correction of an obvious pricing or listing error. Unless expressly stated otherwise, prices do not include applicable taxes, shipping, handling, customs duties, or import charges.

Prices offered online may differ from prices at events, pop-up locations, fundraisers, or through third parties. Promotions may have separate eligibility requirements, dates, exclusions, quantity limits, or other conditions. If promotion-specific terms conflict with these Terms, the promotion-specific terms will control for that promotion.

You agree to provide current, complete, and accurate purchase, payment, shipping, and account information and to update that information when necessary. You represent that you are authorized to use the payment method submitted and agree to pay all charges associated with your order, including applicable taxes and shipping charges.

Section 5 Production, Shipping, Pickup, and Delivery

Production times

Many products require multiple production and curing steps. Resin casting alone may require more than 24 hours, and made-to-order or customized products generally require approximately 7 to 10 business days before shipment or pickup unless a product listing or order communication states otherwise. These timeframes are estimates, not guarantees, and do not include carrier transit time. Complex orders, high order volume, delayed customer responses, material availability, curing conditions, holidays, weather, or other circumstances may extend production time.

If applicable law requires us to obtain your consent to a revised shipment date, we will contact you and provide the options required by law.

Shipping information

You are responsible for supplying a complete and accurate delivery address. We are not responsible for delays, failed delivery, or additional costs caused by an incorrect or incomplete address supplied by the customer. Contact us immediately if you discover an error. We will try to correct it before shipment but cannot guarantee that a change can be made after fulfillment begins.

Carrier delivery dates are estimates and are not guaranteed by us. We are not responsible for carrier, weather, customs, labor, transportation, or other delays outside our reasonable control. Any allocation of risk of loss will be governed by applicable law.

Damage, loss, and delivery problems

Please inspect your order promptly after delivery. If a package or product arrives damaged, if an item is missing, or if you receive the wrong item, contact us as soon as reasonably possible at manualgoalposts@gmail.com. Include your order number and clear photographs of the product, shipping container, packing materials, shipping label, and visible damage. Please retain all packaging while the matter is reviewed because the carrier may require it for a claim.

We will evaluate the circumstances and, when appropriate, repair or replace the item, provide a comparable item if the original cannot be reproduced, issue a refund or partial refund, or assist with a carrier claim. A replacement made from authentic historic material may not look identical to the original because every piece is unique.

Local pickup

If local pickup is offered, pickup instructions, timing, and location will be provided separately. Do not arrive for pickup until you have received notice that the order is ready. Orders not collected within ten days after notice may be subject to additional arrangements or cancellation to the extent permitted by law.

Section 6 Intellectual Property

The Services and their original content, including text, photographs, graphics, product designs, videos, audio, layout, and arrangement, are owned by or licensed to us and are protected by applicable intellectual-property laws. Historic names, school names, logos, marks, photographs, and other materials appearing on products or the Services may belong to their respective owners and are used only as authorized or otherwise permitted by law.

These Terms permit you to use the Services for personal, noncommercial purposes only. Without prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell, or transmit material from the Services, except for ordinary browser caching or personal records connected with your purchase.

Nothing in these Terms grants you a license to use any trademark, service mark, trade name, logo, product design, copyright, or other intellectual property belonging to us, Shopify, duPont Manual High School, the relevant school district, an alumni organization, or any other third party. All rights not expressly granted are reserved by their respective owners.

Section 7 Optional Tools

We may provide access to tools or features offered by third parties that we do not control or monitor. Such tools are provided “as is” and “as available,” without warranties, representations, conditions, or endorsement from us. To the fullest extent permitted by law, we are not liable for issues arising from your use of optional third-party tools.

Your use of any optional tool is at your discretion and may be subject to the third party’s terms and privacy practices. New tools, resources, or features we add to the Services will also be subject to these Terms.

Section 8 Third-Party Links

The Services may include links, materials, or embedded functions provided by third parties. We are not responsible for examining or evaluating third-party content, accuracy, products, services, websites, policies, or practices. If you leave our Services to access a third-party site or service, you do so at your own risk.

To the fullest extent permitted by law, we are not liable for harm or damages connected with third-party websites or with products, services, resources, or content obtained from them. Review a third party’s policies before completing a transaction. Questions or complaints about third-party products and services should be directed to that third party.

Section 9 Relationship with Shopify

Manual Goalposts is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with us. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and us, including any injury, damage, or loss resulting from purchased products and services. To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with us.

Section 10 Privacy Policy

Personal information we collect through the Services is subject to our Privacy Policy, available at Privacy policy – ManualGoalposts.com. Certain personal information may also be subject to Shopify’s Privacy Policy, available through Shopify’s website. By using the Services, you acknowledge that you have reviewed these policies.

Because Shopify hosts the Services, Shopify collects and processes information about access to and use of the Services to provide and improve them. Information submitted through the Services may be transmitted to Shopify and to service providers that may operate in countries other than your country of residence. Review our Privacy Policy for more information about how we, Shopify, and our service providers use personal information.

Section 11 Reviews, Photographs, and Feedback

If you submit, upload, post, email, tag us in, or otherwise provide reviews, photographs, videos, ideas, suggestions, feedback, proposals, or other content (“Feedback”), you grant us a nonexclusive, perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for purposes including operating, improving, and promoting the Services and products.

You represent that you own or have the rights needed to provide the Feedback; that you have disclosed any compensation or incentive connected with it; and that it does not violate any law, these Terms, or another person’s copyright, trademark, privacy, publicity, or other rights. Do not submit images of minors unless you are their parent or legal guardian or have appropriate permission.

We are not required to keep Feedback confidential, pay for it, publish it, or respond to it. We may monitor, edit, or remove Feedback that we believe is unlawful, infringing, deceptive, offensive, threatening, defamatory, obscene, malicious, or otherwise objectionable. You are responsible for your Feedback and its accuracy. You may not use a false identity or misrepresent the source of Feedback.

Section 12 Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, historic details, dimensions, photographs, available options, limited-edition numbers, pricing, promotions, shipping charges, production or transit times, or availability. We may correct or update information and may cancel an affected order at any time, including after submission, subject to applicable law. If we cancel a paid order because of our error, we will refund the affected amount.

Section 13 Prohibited Uses

You may use the Services only for lawful purposes. You may not use the Services, directly or indirectly, to:

  1. violate any applicable law, regulation, or ordinance;

  2. infringe our rights or the rights of another person;

  3. harass, abuse, threaten, defame, discriminate against, intimidate, or harm another person;

  4. submit false, misleading, fraudulent, or malicious information;

  5. transmit spam, unauthorized promotions, chain letters, malware, viruses, or harmful code;

  6. impersonate another person or misrepresent an affiliation;

  7. collect or track another person’s personal information without authorization;

  8. reproduce, scrape, extract, copy, resell, or exploit the Services or their content for commercial purposes without permission;

  9. bypass or interfere with security, access controls, robot exclusions, rate limits, or other protective measures; or

  10. interfere with another person’s use of the Services or engage in conduct that may harm us, Shopify, our customers, or another person.

We may suspend or terminate access if we reasonably determine that these Terms have been violated.

Section 14 Automated Agents

This section applies to software or services that take autonomous or semi-autonomous action on behalf of a person or entity (“Agents”). An Agent may access or interact with the Services only if it truthfully identifies itself, complies with our technical requirements and these Terms, and does not circumvent CAPTCHAs, robot exclusions, access restrictions, rate limits, or other measures used to distinguish or control automated access.

We may restrict or block an Agent’s access at any time. No Agent may continue to access the Services after we have requested that it stop. Agents must not conceal their automated nature, mimic human behavior to evade detection, or answer untruthfully when asked whether an interaction is automated.

Section 15 Termination

We may suspend or terminate your access to all or part of the Services if you violate these Terms, create risk or potential legal exposure, engage in fraud or abuse, or where otherwise permitted by law. You remain responsible for amounts lawfully due through the termination date.

Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, Feedback, product care and safety, warranty disclaimers, limitations of liability, indemnification, severability, governing law, and obligations arising before termination.

Section 16 Disclaimer of Warranties

Information on the Services is provided for general informational purposes. While we make reasonable efforts to keep it accurate, we do not warrant that all information is complete, current, or error-free.

EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY WE PROVIDE AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

THE PRODUCT VARIATIONS DESCRIBED IN SECTION 2, INCLUDING REASONABLE VARIATIONS RESULTING FROM HISTORIC MATERIAL, HANDMADE PRODUCTION, RESIN CASTING, FINISHING, AND SCREEN DISPLAY, ARE NOT DEFECTS OR BREACHES OF WARRANTY.

Some jurisdictions do not permit certain warranty exclusions or limitations. In those jurisdictions, this section applies only to the maximum extent permitted by law and does not limit rights that cannot lawfully be waived.

Section 17 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, PARTNERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANOTHER THEORY, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, or remedies that applicable consumer law requires us to provide. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

Section 18 Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless us, Shopify, and our respective affiliates, owners, partners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, costs, and reasonable attorneys’ fees arising from your material breach of these Terms, your violation of law or another person’s rights, your Feedback, or your misuse of the Services or products.

We will notify you of an indemnifiable claim within a reasonable time. A delay in notice will relieve you of an obligation only to the extent you are materially prejudiced. We may control the defense and settlement at your expense, including the selection of counsel, but will not agree to a settlement that imposes a nonmonetary obligation on you without your consent, which will not be unreasonably withheld. You agree to cooperate in the defense.

Section 19 Severability

If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary. The remaining provisions will remain valid and enforceable.

Section 20 Waiver and Entire Agreement

Our failure to exercise or enforce a right or provision is not a waiver of that right or provision.

These Terms and the policies or operating rules posted through the Services constitute the entire agreement between you and us regarding the Services and supersede prior or contemporaneous communications and proposals on that subject. Product-specific descriptions, written customization confirmations, and promotion terms also apply to the relevant transaction. If a product-specific written term conflicts with these general Terms, the more specific term controls for that product to the extent permitted by law.

Any ambiguity will not automatically be construed against the party that drafted these Terms.

Section 21 Assignment

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent. Any attempted transfer without consent is void. We may assign or delegate these Terms and our rights and obligations as part of a sale, transfer, reorganization, service-provider arrangement, or other lawful business transaction, subject to applicable law.

Section 22 Governing Law and Venue

These Terms and any separate agreement through which we provide Services are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except where federal law applies or the law of your residence provides nonwaivable consumer protections.

To the extent a dispute may lawfully be required to proceed in a particular court, you and we consent to the personal jurisdiction and venue of the state and federal courts located in Jefferson County, Kentucky. This section does not prevent a consumer from bringing a claim in another forum when applicable law gives the consumer a nonwaivable right to do so.

Section 23 Headings

Headings are for convenience only and do not limit or affect these Terms.

Section 24 Changes to These Terms

You may review the current version of these Terms on this page. We may update, change, or replace part of these Terms by posting a revised version to the website. When required by law, we will provide notice of material changes. Changes will take effect on the date stated in the revised Terms or notice and will not retroactively alter an accepted order unless permitted by law and agreed to by the affected customer.

Your continued use of the Services after revised Terms take effect constitutes acceptance of those revised Terms.
